This document is a public offer of the TrueTool online store at https://truetool.com.ua to conclude a distance sale contract on the terms below, in accordance with Articles 633, 641 and 642 of the Civil Code of Ukraine, the Law of Ukraine "On Electronic Commerce" and the Law of Ukraine "On Consumer Rights Protection".
1. Definitions
- Seller — the business entity selling goods through the Website; its name and EDRPOU / tax ID are given on the Contacts page and in the documents for the goods (delivery note, receipt, invoice).
- Website — the TrueTool online store at https://truetool.com.ua.
- Buyer — a legally capable individual aged 18 or over, a company or sole proprietor placing an order on the Website.
- Goods — tools, equipment and related products presented on the Website.
- Order — the Buyer's properly completed request to buy goods, submitted via the Website or by phone.
2. Subject
2.1. The Seller undertakes to transfer the goods into the Buyer's ownership, and the Buyer undertakes to pay for and accept them under this contract.
2.2. The contract is concluded when the Buyer places an order on the Website (ticks the box agreeing to the offer and clicks "Place order") or confirms the order by phone. By placing an order, the Buyer confirms that they have read and accept this offer and the Payment and Delivery, Warranty and Returns and Privacy Policy pages.
3. Placing an order
3.1. The Buyer places an order on the Website, via "Buy in 1 click" or by phone, providing accurate contact and delivery details.
3.2. After the order is placed, the Seller's manager contacts the Buyer to confirm availability, price, payment and delivery. The Seller may decline to confirm an order if the goods are out of stock, in which case any amount paid is refunded in full.
3.3. The Buyer is responsible for the accuracy of the details provided. Extra costs caused by incorrect details (re-delivery, redirection) are borne by the Buyer.
4. Price and payment
4.1. Prices on the Website are in hryvnias. The price is fixed when the order is confirmed and does not change afterwards. Delivery is not included in the price and is paid separately at the carrier's rates unless stated otherwise.
4.2. Payment methods: card online (LiqPay, Pay by mono), PrivatBank or monobank installments, cash on delivery, bank transfer by invoice. The terms of each method are described on the Payment and Delivery page.
4.3. Card and installment payments are processed by the bank; the Seller does not receive or store card details and is not responsible for the actions of banks and payment systems.
4.4. For orders over UAH 4,000 the Seller may require prepayment.
5. Delivery and transfer of goods
5.1. Goods are delivered within Ukraine by Nova Poshta LLC (to a branch, parcel locker or by courier) and Ukrposhta JSC, or picked up. Delivery times are approximate and depend on the carrier.
5.2. Ownership and the risk of accidental damage pass to the Buyer upon receipt of the goods.
5.3. On receipt, the Buyer must inspect the packaging and check the goods for mechanical damage and completeness. If defects are found, the Buyer files a report at the carrier's branch. Claims about appearance and completeness after receipt are not accepted.
6. Warranty, returns and exchange
6.1. The goods are covered by the manufacturer's warranty. Warranty service is described on the Warranty and Returns page.
6.2. A Buyer who is an individual may return or exchange goods of proper quality within 14 days of receipt under Article 9 of the Law "On Consumer Rights Protection" if the goods have not been used and their appearance, completeness and proof of purchase are preserved. Return shipping for goods of proper quality is paid by the Buyer.
6.3. Refunds are made the same way the payment was made within 7 days of receiving and checking the returned goods.
7. Liability
7.1. The parties are liable for non-performance or improper performance of this contract under the laws of Ukraine.
7.2. The Seller is not liable for delivery delays caused by the carrier, or if the goods do not meet the Buyer's expectations while matching the description on the Website. Product images may differ slightly from the actual appearance.
7.3. The parties are released from liability for failure to perform due to force majeure, including martial law, hostilities, power outages and natural disasters.
8. Personal data
By placing an order, the Buyer consents to the processing of their personal data under the Law of Ukraine "On Personal Data Protection" and the Website's Privacy Policy.
9. Other terms
9.1. The Seller may change this offer. Changes take effect when the new version is published on the Website and do not apply to orders confirmed earlier.
9.2. Disputes are settled by negotiation or, failing agreement, in the manner established by the laws of Ukraine.
